Hudson v. Michigan
According to Radley Balko, a policy analyst with the Cato Institute, the decision made in Hudson v. Michigan not to penalize the victim for an improper police search is not a victory but a defeat for American justice.
For as long as I can remember victims of crime have been shafted by a stupid law barring evidence obtained from an improper police search.
Justice goes both ways, you don't sacrifice the justice that a victim deserves because of the wrongdoings of a police officer. Balko thinks that it is legitimate to let a criminal go free in order to punish law enforcement for wrong doing.
Question.
If a police officer (fill in the blank), then you can should punish the victim by letting the criminal off.
